Nebraska nonpayment notice: Lancaster County guide
This guide explains the seven-day opportunity to pay under Nebraska's Uniform Residential Landlord and Tenant Act and the limited circumstances supported here. The notice, rent statement and delivery record are separate from these instructions. This is an independently prepared statutory notice, not a court-issued or court-approved form. Sources reviewed October 27, 2026.
1. Confirm the address and the kind of tenancy
This form covers a lawful ordinary residential rental in unincorporated Lancaster County, outside every city, village and their extraterritorial planning areas. A Lincoln mailing address does not establish city jurisdiction, and a rural address does not establish that county zoning alone applies. Check the parcel's actual boundaries. Lancaster County Zoning Regulations § 3.011 exclude municipal extraterritorial areas from the county districts, with distances tied to the municipality's class and specified ordinance exceptions.
The same regulations address lawful occupancy. Section 20.001 requires a certificate for specified changes of use, occupancy or occupancy classification; § 20.003 addresses building permits and occupancy. These provisions are not an eviction notice period or a representation that every existing rental needs a new certificate on each tenancy. Resolve a disputed conversion or occupancy status before relying on this form.
§ 76-1408 excludes several arrangements from the residential act, including principally agricultural premises, transient hotel occupancy, employment-dependent occupancy, purchase contracts and certain institutional housing. A residential home on rural land is not automatically an agricultural tenancy. Mobile-home lots, commercial uses and uncertain classifications need their own review. Assisted housing, covered mortgages, extra lease notice requirements and special legal protections are outside this form's supported scope; selecting an answer does not resolve their applicability.
2. Identify the overdue rent and the conditional demand
§ 76-1431(2) permits termination when rent is unpaid when due and the tenant does not pay within seven calendar days after written notice of nonpayment and the landlord's intention to terminate if payment is not made within that period. The notice therefore identifies the unpaid rent and states that conditional intention. It does not declare an immediate eviction or substitute for the different breach procedures elsewhere in § 76-1431.
Compare the lease, any grace period, rent ledger, receipts and deposit records before entering a row. List a past due date and the unpaid occupancy rent for each period. This form intentionally excludes late fees, utilities, damages, collection expenses, legal fees, payments and credits. That narrow scope is a product limit, not a declaration that every excluded charge is unlawful. If a payment was made, a credit is due, a concession changes the balance or the amount is contested, reconcile it through a separate review rather than describing it as new undisputed rent.
Payment instructions should identify the recipient and a workable payment location or method consistent with the rental agreement. They should not introduce a new fee or obstacle to timely payment. The rent statement accompanies the demand so the tenant can identify how the total was reached.
3. Count from receipt and check the last day
The date the landlord prepares or signs the notice is not proof of receipt. Under § 76-1431(2), the statutory payment opportunity follows receipt of the written notice. Keep the actual receipt date for each recipient. This form uses a relative seven-calendar-day demand, preserves any longer period required by law, and does not invent a planned service date, exact termination date or court-filing date.
§ 25-2221 generally excludes the triggering day and includes the last day, extending an ending day that is Saturday, Sunday or a day courts may legally close to the next open day. The statute's annotations explain both its broader application and the possibility of a controlling specific rule. Do not treat “calendar days” as permission to ignore an applicable last-day extension. Confirm the receipt evidence, governing time rule, holiday, lease requirement and any relevant order before deciding when a filing is timely.
4. Deliver the complete notice and document the event
§ 76-1413(2)(c)(i) recognizes a notice delivered in hand to the tenant. This form is limited to printed personal delivery to each named adult tenant. Give the signed notice and every rent-statement page together; keep an identical copy. The separate delivery record states who actually received the papers, where, when and from whom. It remains blank until those facts exist. Preparing a file, signing it or choosing Share is not evidence of delivery.
The statute also addresses mail and qualifying electronic delivery, but this form does not prepare those methods or posting, substituted delivery or an absent-tenant procedure. If personal delivery cannot be completed, review a lawful alternative and its receipt rules instead of filling in a delivery event that did not happen. Service of later court papers is a separate procedure.
5. Electronic signing and Nebraska's electronic-delivery rules
Optional electronic execution relies on actual agreement and intent, subject to Nebraska's Uniform Electronic Transactions Act: § 86-630 addresses scope and substantive law; § 86-632 requires each party's agreement to conduct the transaction electronically; § 86-634 recognizes electronic records and signatures. This form asks the signer to confirm agreement for this notice. If that is not established, use the paper-signature option. A landlord's checkbox cannot establish another person's agreement.
Signing does not authorize electronic delivery. The 2025 amendments to § 76-1413(4)-(16) set separate requirements, including affirmative tenant consent, required disclosures, demonstrated access, withdrawal procedures and paper-copy rights. Consent cannot be made a condition of the lease. The law also addresses failed delivery, receipt verification where required, and fallback to nonelectronic methods when there is a reasonable basis to believe delivery failed. Ordinary email consent or a messaging-app share should not be assumed sufficient.
§ 86-635 preserves applicable requirements for presentation and delivery and requires covered electronic records to be retainable. This website does not collect tenants' delivery consents or verify receipt. Its supported workflow remains printing and personal delivery even when the landlord signed electronically.
6. Reassess payment, habitability and other defenses
§ 76-1433 makes acceptance of rent with knowledge of a default, or acceptance of performance varying from the agreement, a waiver of the right to terminate for that breach unless otherwise agreed after the breach. Do not assume that labeling a payment “partial” preserves the existing termination claim. Preserve the payment date, amount, allocation and any later agreement, then reassess the notice and next step. The form does not decide the legal effect of accepting a payment.
Habitability disputes can affect the amount recoverable. § 76-1427 provides specified remedies after written notice for certain failures to supply essential services, subject to its conditions and exceptions. § 76-1428 addresses tenant counterclaims, possible court-ordered rent deposits and the net amount owed; where no rent remains due after application, judgment is for the tenant. Do not dismiss a repair deduction or counterclaim merely because the ledger shows a balance.
§ 76-1439 restricts retaliation following specified government complaints or tenant organization activity and contains exceptions, including rent default. An exception allowing an action does not erase other landlord obligations. A complaint, accommodation request, bankruptcy, military issue or existing court order calls for individual review.
7. Before seeking possession in court
Expiration of a notice period is not a possession order. § 76-1440 directs possession actions through the statutory court process. Under § 76-1441, a complaint for restitution must identify the statutory authority, particular supporting facts, premises and compliance with notice requirements. Keep the lease, final notice and attachments, delivery evidence, full payment history and relevant communications for that review.
Check the Third Judicial District's county-court rules and current Lancaster County court directions before filing or appearing. The remote-proceedings protocol presumes in-person proceedings and sets conditions for remote participation; emergency orders may alter operations. Downloading this notice does not open a case or schedule a hearing. Under § 76-1430, unlawful exclusion or wrongful interruption of essential services can expose a landlord to possession-related remedies, three months' periodic rent as liquidated damages and a reasonable attorney's fee. Do not change locks, cut utilities or remove belongings as a substitute for court process.
8. Completing the blank form
Apply the same scope checks before using the printable version. Enter the notice date, all tenants, full rental address, unpaid-rent total, payment instructions, landlord name and mailing address. Complete the dated rent statement and make its total agree with the notice. Sign and date the notice. The final page is a factual record of personal delivery, not a certificate that delivery has already occurred. Complete it after the event and keep it with your records. Extra ledger pages should identify the same tenants, premises and notice date and travel with the demand. If the circumstances change before delivery or filing, reassess the document and legal basis first.
