Iowa nonpayment notice: unincorporated Linn County guide
Iowa Code section 562A.27(2) permits termination for unpaid rent after written notice of the nonpayment and the landlord's intention to terminate if the rent is not paid within three days. The notice must preserve that opportunity to pay. It is not an immediate eviction order, a clear-and-present-danger notice or a general notice ending a month-to-month tenancy.
1. Check the property, tenancy and local housing requirements
This form is limited to an ordinary residential rental in unincorporated Linn County, outside incorporated city boundaries. A Cedar Rapids mailing address does not establish that the property is inside or outside the city. Confirm the actual property jurisdiction. The supported rental must be registered and compliant; the tool does not inspect the property or certify its legal status.
Linn County Code sections 105-101 through 105-103 address the county housing code. Section 105-102 defines a permitted rental unit by county registration and housing-code compliance and addresses a certificate following an inspection finding compliance. Section 105-103 limits application within incorporated cities unless the specified city adoption and intergovernmental agreement exist. Those provisions are not a county-specific three-day deadline; they explain why property location and compliance must be checked separately.
The supported case is new, undisputed unpaid periodic rent, with adult tenants competent to receive personal service. Mobile-home lots, transient stays, commercial uses and tenancies excluded by section 562A.5 are outside this form. Housing assistance, covered or uncertain financing, extra lease requirements, prior notices, unknown occupants and special protections also require another review. These are limits of this tool, not a declaration that all other situations have the same legal result.
2. State the rent default and the conditional intention to terminate
Identify every named tenant, the complete rental address, the landlord and the date of the notice. List each past-due rent date and unpaid amount in the attached statement, and make its total agree with the demand. Section 562A.27(2) concerns rent unpaid when due. Check the lease's due date and any applicable grace period before calling a charge overdue.
The statement in this form demands rent only. It excludes late fees, utilities, damages, legal costs and future rent. Section 562A.9(4) regulates certain late fees, but that does not make every fee permissible or appropriate to add to this demand. Do not relabel a fee as rent. Provide usable payment instructions identifying the recipient and where or how the tenant can make payment under the rental agreement. A payment direction should not create an obstacle to timely payment.
The demand says that the landlord intends to terminate if full rent is not paid within the specified period. It does not tell the tenant that moving out is the only way to respond or declare the tenancy already terminated. The attached rent statement forms part of the notice and must accompany it.
3. Review payments, repairs and defenses before relying on the balance
Section 562A.30 addresses waiver when a landlord accepts performance different from the rental agreement. Its temporary-waiver provision has its own notice and reliance conditions. This tool does not decide the effect of a partial payment, credit, payment arrangement or earlier waiver. Reconcile any changed balance and obtain a separate review instead of continuing with an outdated demand.
Sections 562A.23 and 562A.24 address essential services and certain counterclaims. Section 562A.27(4) provides a repair-related defense subject to specific conditions, including prior notice at least seven days before rent was due, reasonable correction costs no greater than one month's periodic rent, and good-faith correction before receipt of the termination notice. This is not an unrestricted right to deduct any repair expense. It also means a landlord should not dismiss a documented deduction without examining the required facts.
Section 562A.36 addresses retaliation, including qualifying complaints and tenant organizing, and contains exceptions and continuing-liability provisions. A rent-default allegation does not settle every defense. Disputes about repairs, code enforcement, discrimination, accommodations, military service, bankruptcy or court orders fall outside this form's routine workflow.
4. Calculate time from actual valid service
Section 562A.8A directs that chapter 562A time periods be calculated under section 4.1(34). Its general rule excludes the first day and includes the last, with extension through the following Monday when the last day is Sunday. The same subsection has broader rules for specified court filings; those are not a reason to automatically call this notice three business days.
For the personal-service method supported here, record the actual service event. The date the landlord creates, signs or downloads the notice is not proof of service. This form states the relative three-day period and does not calculate a calendar expiration or the earliest filing date. Review controlling requirements before taking the next step, especially if tenants were served on different days. Do not substitute a planned delivery date for what actually happened.
5. Use the selected service method and obtain the server's proof
Section 562A.29A(1)(b) permits personal service under Iowa Rule of Civil Procedure 1.305. This form uses personal delivery to each named adult tenant by a disinterested adult server. Rule 1.302(4) excludes a party and a party's attorney from serving original notice. Rule 1.305(1) addresses adults who have not been adjudged incompetent. Substituted service, minors and other special recipients require a separate review.
The Linn County Sheriff's guidance recommends serving all adult tenants through a disinterested third party and says the person serving needs an affidavit of service. Rule 1.308 identifies the time, manner, place and person receiving the copy as essential return information. The separate affidavit supplied here records those facts for this rent notice and its statement; the private server completes and swears to it after service. It is not automatically completed by the landlord's signature. Keep separate proof for separate recipients or events.
Section 562A.29A also provides a signed-and-dated adult-resident acknowledgment method and a posting method combined with both regular and certified mail. For statutory mail service, subsection (2) addresses completion four days after deposit and postmark. Those alternatives are outside this personal-service form; a single mailing or a photograph of a posted notice is not a substitute for all requirements of the selected method. Email, text and the sharing menu do not perform the personal service used here.
6. Choose execution separately from delivery
Paper signing remains available. Iowa Code section 4.1(39) includes electronic signatures as defined in chapter 554D. Sections 554D.104, 554D.106 and 554D.108 address scope, the parties' agreement and legal recognition. Use optional electronic signing only when every named tenant and the landlord have agreed to electronic signatures for this notice and no conflicting execution requirement applies. A landlord's own confirmation does not create the tenant's agreement.
Section 554D.110 preserves requirements for specified delivery methods and formats. Retain a printable signed copy and arrange the selected paper service. The server's sworn affidavit is separate; the notice's electronic-signature control does not notarize it or establish that delivery occurred.
7. Distinguish the rent notice from a court case
If rent remains unpaid after proper notice and the applicable period, review the grounds, service evidence and defenses before filing a forcible-entry-and-detainer action under chapter 648. Section 648.3 addresses when a separate notice to quit is unnecessary, including certain terminations following section 562A.27 notice. It does not dispense with valid service, the required waiting period or the later court process.
Sections 562A.26 and 562A.33 restrict unlawful exclusion and interference with essential services. This notice supplies no authority to change locks, cut utilities or remove occupants or belongings. A later court order and enforcement process are separate steps. Follow current court and sheriff instructions; do not treat the prepared notice, its affidavit or a download confirmation as a judgment for possession.
8. Review and retain the complete documents
The blank version contains a notice, rent statement and separate affidavit of personal service. Fill in the notice and statement, check the total and payment directions, and sign the notice. Service facts and the server's oath remain blank until actual service and execution of the affidavit. The person authorized to administer the oath completes the jurat. Keep the lease, payment history, served notice and statement, and completed service proof together.
This is a privately prepared statutory notice and affidavit, not an official court form or a promise of court acceptance. Sources include the 2026 Iowa Code, the civil rules reviewed in September 2026 form, and the county's published guidance and housing-code text reviewed October 25, 2026; the central nonpayment, service, timing, waiver and possession provisions were rechecked October 27.
