Massachusetts rent notice: a Charlemont landlord's guide
A fourteen-day termination notice, a conditional ten-day right to cure, and the required state information form serve different purposes. Check each before delivering a notice. The explanation below applies to the limited Charlemont tenancy-at-will form, not every Massachusetts rental.
1. Identify the tenancy before choosing a notice
G.L. c.186, §12 provides the fourteen-day written notice for nonpayment by a tenant at will. This form supports an existing, lawful, ordinary long-term month-to-month rental within Charlemont, Franklin County, with no unexpired fixed-term lease. A mailing address or ZIP code does not establish the town boundary.
A tenancy at will may arise under an oral or written agreement; having something in writing does not by itself make the tenancy a fixed-term lease. Read the actual agreement, including extensions, before selecting this form. Fixed-term leases have a different statutory provision in §11 and may have additional contractual requirements. A no-fault termination, lease violation or expired lease must not be relabeled as unpaid rent.
Assisted housing, uncertain federal coverage, short stays, accessory units, mobile homes and other special housing are outside this form. So are earlier notices, existing litigation, extra notice terms and disputed accounts. A longer period or different process cannot be avoided by selecting the ordinary-rental option.
2. Reconcile the rent and disclose repayment agreements
List each unpaid rent installment once, with its true due date and exact amount. This form demands rent only; it does not add late charges, utilities, deposits, legal fees or anticipated court costs. Compare the ledger with receipts, transfers and any credits before preparing the notice. A partial payment or disputed credit requires review, rather than leaving it out to obtain a larger total.
G.L. c.186, §31 requires information concerning agreements to repay overdue rent. The state's form asks about written or verbal agreements. Any existing written agreement must accompany it, and a verbal agreement must be disclosed using the appropriate choice. This simplified form is limited to cases with neither type of agreement. Its final review confirms that condition before the prepared attachment marks the no-agreement box; uncertainty is not permission to select “none.”
The state's completion instructions call for all landlords and tenants to be identified. Joint owners should not be omitted simply because one owner manages the property. When there is no lease, the instructions address known adult residents as well. Resolve uncertainty about the proper parties before serving a notice.
3. Distinguish the fourteen-day notice from the ten-day cure right
Section 12 requires the notice to contain the complete conditional cure paragraph. It gives a tenant who has not received a similar nonpayment notice within the preceding twelve months a right to prevent termination by paying or tendering the full rent due within ten days after receiving the notice. Payment may be made or tendered to the landlord, the landlord's attorney or the person customarily receiving rent. The fourteen-day termination date does not replace this ten-day rule.
The notice retains the paragraph exactly, including its condition about prior notice. Do not delete it because you believe the tenant previously received a notice. Section 12 extends the cure opportunity to the answer-due date in a later possession case when the required notification is omitted. That consequence is a reason to check the wording carefully, not a method for shortening tenant rights.
Section 12 also provides a separate protection when nonpayment results from government delay in delivering a qualifying subsistence or rental payment. In the circumstances specified there, the court must continue the hearing for at least seven days and notify the agency; qualifying tender during that period prevents treating the tenancy as terminated. Preserve assistance and payment communications and obtain review when those facts arise.
4. Set the termination date from actual receipt
The Massachusetts Court System's eviction guide explains that the tenant must actually receive the notice. This form assumes every named tenant personally receives every page on the notice date. It provides at least fourteen full days after that date. If a tenant receives it later, prepare a fresh notice and termination date; creating, signing or downloading a document does not prove receipt.
G.L. c.4, §9 addresses acts due on Sunday or a legal holiday, subject to its exceptions. Legal holidays are defined in §7. This form also moves a Saturday end date later as a conservative product restriction; that is not a statement that §9 universally treats Saturday as a holiday. Intermediate weekends are not all removed from the fourteen-day period.
The displayed termination date is not a calculated filing date or the tenant's cure deadline. Check actual receipt, the agreement, payments, court orders and applicable protections before deciding the next step. The reviewed date range shown by the form limits its calendar; do not reuse an old generated notice for a new delivery.
5. Include the complete state information form
Section 31 requires the notice to be accompanied by the state's Form to Accompany Residential Notice to Quit. The retained August 28, 2026 revision has twelve pages, including the required information in multiple languages. It explains that the notice is not an eviction, identifies assistance resources and gives information about the court process and federal restrictions.
All twelve original pages remain with the notice. Their official explanations, website addresses and translations are required accompanying material, distinct from our website's instructions to the landlord. Do not remove pages because the notice itself is in English, or replace the state form with a short summary. Section 31 bars acceptance of the specified nonpayment case filings without proof that the required form was delivered.
With the blank download, complete the party and address details on the state form and answer its agreement questions accurately. The online version fills those details only from the reviewed notice information. Rental assistance or mortgage coverage may change the required notice; charging market rent alone does not establish that a property is outside federal protections.
6. Sign on paper and keep evidence of receipt
This form uses a handwritten landlord signature after printing. G.L. c.110G, §3 excludes specified primary-residence default, eviction and cure notices from its general electronic-transaction rules. That exclusion does not establish a ban on every electronic signature, but it prevents treating general electronic-signature consent alone as sufficient authority for this notice. No separate execution basis has been established for this form.
The court guide allows direct delivery and recommends that a disinterested person be present. It warns that leaving a notice at an address or mailing it without actual receipt may be insufficient. This form supports personal receipt by every named tenant. Keep a separate factual record for each recipient, stating the actual date, time, place, person delivering and complete set of documents received. An optional witness can record what that person actually observed.
Leave delivery facts and the delivery signature blank until the event occurs. Emailing, texting or sharing a file does not establish the personal receipt required by this workflow. The record supports evidence of what happened; it does not certify that a court will find the notice legally sufficient.
7. Check property conditions and Charlemont obligations
G.L. c.239, §8A permits relevant defenses and counterclaims in covered residential nonpayment proceedings. Claims about conditions have specific requirements, including the landlord's knowledge before rent arrears and rules about who caused the conditions. Inspection findings, repairs, offsets and the amounts owed by each side can affect possession. Do not treat a ledger balance as resolving a housing-condition dispute.
G.L. c.186, §18 protects specified complaints, enforcement efforts and tenant-organization activity from reprisals. A repair complaint, accommodation request, domestic-violence protection, bankruptcy or military issue needs a separate assessment. The form's confirmation cannot waive these protections.
Charlemont's general bylaws, Right to Manage and Harvest Forest and Farm Products, §4, require a local disclosure before acquiring a leasehold or possessory interest, with the specified signed copy filed with the town. This is an existing occupancy obligation, not a new statement to insert into every rent demand. Required permits and disclosures must already be current. The town's short-term rental and special land-use provisions have separate purposes; this form does not approve an individual unit's use or supply missing permits. Consult the town's current bylaws and departments for the property's actual situation.
8. Review every page and use the court process if necessary
Before delivery, review all names, addresses, dates, rent entries, payment instructions and accompanying-form answers. Sign the completed notice by hand and keep a full copy. When using the blank form, write legibly and verify the notice period yourself; the blank document does not calculate it. The separate receipt record is completed afterward.
If the notice period ends and possession remains disputed, follow the court's current summary-process procedure. The later summons and complaint require service by an authorized constable or sheriff and subsequent filing; they are not replaced by this notice or its receipt record. Acceptance of rent or a new agreement can affect whether an earlier termination remains effective. Review those events before proceeding.
A notice does not authorize a lockout or removal without lawful process. Keep the tenancy agreement, ledger, payment records, signed notice, all attachments and receipt evidence. Claims to collect money after a tenant has left may require a different proceeding. Use the court's current forms, rules and scheduling information rather than assuming the notice's expiry is a hearing or filing date.
Reviewed October 27, 2026. The cited state statutes, retained August 28, 2026 information form, court guidance and identified Charlemont provisions were reviewed for this limited scope. This custom notice is not a determination of legal sufficiency for an individual case.
